Terms and conditions

These Terms and Conditions apply to purchases made through vandervorm.art and to commissions for custom paintings.
1. Agreement
An agreement is formed once an order has been confirmed by vandervorm.art or a proposal for a custom painting has been accepted by the client.
For a custom painting, the specific agreements regarding the subject, execution, price and estimated timeframe are confirmed in writing in advance.
2. Prices and Payment
All prices are stated in euros and include applicable taxes, unless otherwise indicated.
For purchases, full payment is required before the artwork is delivered.
For custom paintings, the payment schedule stated in the proposal or commission confirmation applies.
3. Delivery
Vandervorm.art carefully packages and ships all artworks.
The estimated delivery time is communicated in advance. If shipping, installation or special transportation is not included in the price, these costs will be communicated in advance.
Collection in Breda is possible by prior arrangement.
4. Custom Paintings
A custom painting is developed based on the information and context provided by the client.
Vandervorm.art determines the final artistic execution, including composition, colour, form, materials and visual language.
Sketches, studies and other elements of the artistic process are not automatically provided to the client.
Changes that fall outside the original agreement may result in additional costs or a longer delivery time.
5. Right of Withdrawal and Returns
Consumers have a statutory right of withdrawal where applicable.
For artworks specifically made according to the client's wishes, the right of withdrawal does not apply where this is permitted by law.
If an artwork is damaged during shipping, the buyer must report this as soon as possible after delivery and provide photographs of both the artwork and the packaging.
These terms do not limit any statutory consumer rights.
6. Copyright
Copyright in the artworks, photographs, sketches and other creative work remains with vandervorm.art unless otherwise agreed in writing.
Purchasing an artwork does not transfer copyright.
The buyer or client may own and display the purchased artwork.
Images of the artwork may be used by the buyer or client for their own communication, such as on their website, social media and in presentations, with attribution to the artist where reasonably possible.
Reproduction or commercial use of the artwork or images of it, for example for prints, cards, books or merchandise, is only permitted with prior written permission from vandervorm.art.
7. Use by vandervorm.art
Vandervorm.art may use images of sold and commissioned artworks for its portfolio, website, social media, exhibitions, publications and other artistic or promotional purposes, unless otherwise agreed in writing in advance.
8. Complaints
Complaints should be submitted in writing as soon as reasonably possible using the contact details provided on the website.
Vandervorm.art will make reasonable efforts to address complaints carefully and within a reasonable timeframe.
9. Liability
Vandervorm.art is not liable for damage caused by circumstances beyond its reasonable control, such as delays or damage caused by third parties.
This provision applies to the extent permitted by law and does not exclude or limit liability that cannot legally be excluded or limited.
10. Governing Law
All agreements with vandervorm.art are governed by Dutch law.
For consumers, any mandatory statutory consumer protections applicable to the agreement also apply.
